If prices of the houses go up the buyer would be more likely to exercise his option and buy the house. If prices went down, he could simply choose not to buy. Which means he would not have to sell the house, would not have to pay marketing and sales so costs and could simply leave as he could under the terms of the lease.
In a perfect world, you would file a trademark application with the Patent & Federal Trademark Registration Office as soon as you are sure that you will be moving forward with a new product or service that carries a mark. The reason for this is twofold. The first reason is to use the trademark search process to see if there is any other mark already filed or being used that might conflict with yours. If so, you can either negotiate to purchase the right to use the mark or choose a different mark.
